By accessing our website, submitting an inquiry, booking services, signing a rental agreement, or communicating with us by phone, email, or text message, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These Terms apply to all users, customers, and communications associated with Freez Bros Rentals LLC, including those managed through CRM and messaging platforms.
Section 01
Services
Freez Bros Rentals LLC provides climate-controlled safety trailer rentals — including cooling and heating units — along with optional add-ons such as 50A/240V generator rentals and Starlink internet service, to commercial, municipal, and residential customers throughout Arizona.
All services are subject to availability, acceptance, and the terms of a signed rental agreement. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.
Add-On Services: Optional generator and Starlink internet rentals are governed by the same terms as the trailer rental unless otherwise specified in a separate agreement.
Section 02
Use of Website
You agree to use our website for lawful purposes only. You may not:
- Use the website in a way that violates any applicable laws or regulations
- Attempt to gain unauthorized access to any systems or data
- Interfere with the operation or security of the website
- Submit false, misleading, or fraudulent information
We reserve the right to restrict or terminate access for violations of these Terms.
Section 03
Insurance Requirements
⚠ Required Before Trailer Release
Prior to release of any trailer, Lessee must provide a valid Certificate of Insurance (ACORD 25). Failure to provide compliant certificates prior to checkout voids the rental agreement and Freez Bros Rentals LLC has no obligation to release the trailer.
Required minimum coverage includes:
- Commercial General Liability: Minimum $1,000,000 per occurrence / $2,000,000 aggregate — naming Freez Bros Rentals LLC as an Additional Insured
- Property / Inland Marine: Coverage sufficient to cover the full replacement value of the rented trailer and all included equipment
- Policy Duration: All policies must remain in effect for the full duration of the rental period
Section 04
Quotes, Reservations & Payments
Any quotes provided are estimates only and are subject to change based on availability, scope, location, duration, and other factors. Reservations are not guaranteed until confirmed in writing by Freez Bros Rentals LLC.
- Payment: You agree to pay all charges on demand, including rental time, applicable taxes, fees, fines, and any administrative costs incurred by Freez Bros Rentals LLC in connection with your rental
- Late Payment: A 5% late payment fee applies to all amounts paid past the due date
- Returned Checks: A fee of $100 or the maximum permitted by law (whichever is greater) applies to any returned or unpaid check
- Traffic / Toll Violations: You are responsible for all fines, penalties, and citations plus a $100 administrative fee per incident
- Cleaning Fee: A fee not to exceed $500 may be charged if the trailer is returned substantially less clean than when rented
- No Early-Return Refund: No refund of time or mileage charges will be issued if the trailer is returned before the scheduled return date
- Sales Tax: All rental payments are subject to applicable Arizona state and local sales tax, which is the responsibility of the Lessee
Payment terms, deposits, rental duration, delivery fees, and cancellation policies may be further outlined in a separate rental agreement or invoice.
Section 05
Deposit
A deposit in the amount stated in the rental agreement must be paid prior to checkout of the trailer. The deposit is held as security for the full and faithful performance of all Lessee obligations.
- Freez Bros Rentals LLC may apply the deposit toward any amounts owed without prior notice to Lessee
- Any unused portion of the deposit will be returned within 14 business days following return and inspection, accompanied by an itemized written statement of any deductions
- The right to deduct from the deposit does not limit Freez Bros Rentals LLC's right to pursue additional amounts owed beyond the deposit amount
- The deposit shall not be applied toward rental payments unless expressly agreed to in writing
Section 06
Trailer Condition & Return
You must return the trailer to the agreed location on the date and time specified in your rental agreement, and in the same condition as received, except for ordinary wear.
- Checkout Photos: Date-stamped photographs of the trailer's interior, exterior, hitch, tires, and all included equipment will be taken by Freez Bros Rentals LLC at checkout in Lessee's presence. These photographs constitute the official condition record at the start of the rental period
- Return Inspection: A return inspection will be conducted at check-in, with date-stamped photos compared against checkout photos to document any new damage, missing equipment, or condition changes
- Lessee Absent at Check-In: If Lessee is not present at check-in, Lessee waives the right to dispute any damage findings made during the return inspection, provided findings are documented with date-stamped photographs within 24 hours of trailer return
- After-Hours Return: If the trailer is returned after hours, Lessee remains responsible for safety and any damage until inspection occurs at next business opening
- Repairs During Rental: Any service or replacement of parts during the rental period requires prior written approval from Freez Bros Rentals LLC
Section 07
Responsibility for Damage or Loss
You are responsible for all damage to, loss of, or theft of the trailer and included equipment — including damage caused by weather, road conditions, and acts of nature — whether or not you are at fault. All accidents involving the trailer must be reported to Freez Bros Rentals LLC and the police within 24 hours of occurrence.
You are also responsible for:
- Cost of repair or actual retail cash value if the trailer is not repairable or if we elect not to repair it
- Loss of Use (calculated by multiplying days out of service by the daily rental rate)
- Diminished Value — the difference between the trailer's actual cash value before and after damage
- Missing equipment at the replacement values listed in Section 8
- Reasonable administrative expenses connected with any damage claim
Total Loss: In the event of total loss, theft, or destruction of the trailer — whether caused by accident, negligence, fire, weather, vandalism, or any other cause — Lessee is responsible for the full replacement cost of $25,000, regardless of the trailer's depreciated or actual cash value at the time of loss.
Section 08
Equipment & Replacement Costs
Each trailer includes the following permanent fixtures and equipment. Lessee is responsible for returning all items in good working condition. Replacement costs are fixed, non-negotiable, and not subject to depreciation adjustment.

Partial damage to any item that renders it non-functional shall be treated as a total loss of that item. Lessee's liability for replacement costs survives the termination or return of the trailer and remains enforceable until paid in full.
Section 09
Prohibited Uses
The following uses of the trailer are strictly prohibited:
- Transporting dangerous, hazardous, or illegal materials
- Transporting living persons inside the trailer while in motion
- Towing the trailer under the influence of drugs or alcohol
- Allowing the trailer to be towed by anyone not listed as an Authorized Driver
- Use obtained through false, fraudulent, or misleading information
- Use in furtherance of any illegal purpose
- Use outside the United States
- Loading beyond the manufacturer's rated capacity
- Towing through structures without sufficient overhead or side clearance
- Occupying the trailer while it is still attached to the towing vehicle
- Occupying the trailer before all 4 stabilizer jacks are deployed and the trailer is secured and level
- Placing signs, lettering, or paint on the trailer
- Any intentional, wanton, willful, or reckless conduct causing damage
- Any unauthorized modifications or tampering with fixed equipment or fixtures
Section 10
Safety & Stabilization Requirements
⚠ Safety Critical — Read Before Use
Failure to comply with stabilization requirements may result in serious injury or death. Occupancy of the trailer is strictly prohibited until all requirements below are satisfied.
- All 4 corner stabilizer jacks must be fully deployed and the trailer confirmed level and secure before any person enters or occupies the trailer
- Lessee will be physically shown the location and operation of all stabilizer jacks at the time of checkout
- Occupancy of the trailer while attached to a towing vehicle is strictly prohibited
- Lessee assumes full liability for any injury, damage, or loss resulting from failure to comply with these stabilization requirements
- Freez Bros Rentals LLC shall not be liable for injuries or damages resulting from Lessee's failure to properly stabilize the trailer
Section 11
Electrical System & Grounding Requirements
⚠ Electrical Hazard — Grounding Required Before Occupancy
Failure to properly ground the trailer may result in electric shock, fire hazard, or equipment damage. Occupancy is strictly prohibited until grounding is complete and verified.
The trailer is equipped with:
- 50A power inlet mounted externally for supplying power to the trailer
- 30A quick disconnect connection exterior mounted for the mini-split HVAC system
- Main breaker panel located inside the trailer for internal power distribution
Grounding Requirements:
- Lessee is responsible for properly grounding the trailer prior to use
- A grounding rod must be driven into the ground (minimum 4 ft depth, copper or galvanized steel rod recommended) and bonded to the trailer's grounding lug using approved copper wire and a listed ground clamp
- Lessee must verify grounding is complete before allowing any occupancy
- Lessee will be verbally briefed on all electrical requirements at the time of checkout
Freez Bros Rentals LLC assumes no responsibility or liability for any injury, equipment malfunction, fire, or death resulting from improper electrical connection or failure to ground the trailer. Lessee assumes full liability for the safe installation, use, and disconnection of all electrical systems.
Section 12
Indemnification
Lessee shall defend, indemnify, and hold harmless Freez Bros Rentals LLC, its owners, officers, employees, and agents from and against any and all claims, demands, lawsuits, judgments, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
- Any bodily injury, illness, or death sustained by any person — including Lessee's employees, contractors, subcontractors, agents, site visitors, or any third party — occurring in, on, around, or in connection with the trailer during the rental period
- Any property damage caused by or related to the trailer or its use during the rental period
- Any violation by Lessee of applicable federal, state, or local laws, regulations, or safety standards
- Any failure by Lessee to properly install, operate, maintain, ground, stabilize, or secure the trailer in accordance with this Agreement
This indemnification obligation survives the termination or expiration of the Agreement and is not limited by the existence or amount of any insurance coverage maintained by either party.
Section 13
Limitation of Liability
To the maximum extent permitted by law, Freez Bros Rentals LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of our website or services. Use of rental equipment is at the customer's own risk and subject to the terms of the applicable rental agreement.
We make no warranties, express, implied, or apparent, regarding the trailer — including no warranty of merchantability and no warranty that the trailer is fit for a particular purpose.
Section 14
SMS & Email Communications
By providing your contact information and opting in, you consent to receive communications from Freez Bros Rentals LLC via phone, email, or text message (SMS/MMS), including service updates, scheduling notices, and promotional messages.

Intellectual Property
All content on this website — including text, images, logos, graphics, and branding — is the property of Freez Bros Rentals LLC and may not be copied, reproduced, modified, or distributed without prior written consent.
Section 16
Third-Party Services
Our website and communications may include links to or integrations with third-party platforms. We are not responsible for the content, policies, or practices of any third-party websites or services.
Section 17
Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services, the parties agree to first attempt resolution through good faith negotiation for no less than 15 days following written notice of the dispute.
If not resolved through negotiation, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with arbitration to take place in Maricopa County, Arizona. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the above, Freez Bros Rentals LLC reserves the right to seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use, repossess the trailer, or recover unpaid amounts without first submitting to arbitration.
Section 18
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You irrevocably consent to personal jurisdiction in such courts and waive any objection to venue in Maricopa County.
Section 19
Modifications & Waiver
No term of these Terms can be waived or modified except by a writing signed by Freez Bros Rentals LLC. A waiver of any breach is not a waiver of any additional breach or of performance obligations. If any provision is deemed void or unenforceable, the remaining provisions remain valid and enforceable.
We reserve the right to update or modify these Terms at any time. Changes are effective upon posting to this page. Continued use of our website or services constitutes acceptance of updated Terms.
